The Most Famous Tort Cases

In the development of the concept and principles of tort law in this country the courts, in relation to various aspects of the topic, have reached many significant decisions. By way of illustration, one of the most famous cases in the whole of the law of tort must be the seminal decision in Donoghue v. Stevenson [1932] AC 562 in relation to the establishment and future development of the law of negligence in relation to as to how a case is taken to arise. The laws development in relation to the recognition of the law of negligence was then taken on a stage further in the decision in Caparo Industries Plc v. Dickman [1990] 2 AC 605 regarding the proximity of the relationship and the foreseeability.

Moreover, in relation to the law of nuisance a subset of rules has developed in the form of the rule in Rylands v. Fletcher (1866) LR 1 Exch 265 leading to the effective development of the concept of strict liability in this area. Furthermore, the recognition of economic loss has been specifically derived from the decision in Hedley Byrne v. Heller & Partners Ltd [1963] 2 All ER 575, whilst the concept of causation was largely effectively qualified in Bolitho v. City & Hackney Health Authority [1997] 4 All ER 771.
