The claimant bought a Ferrari at an auction in Monaco. On having the car delivered to his home in England he found that it did not match the description of the auction catalogue. He raised proceedings in England for damages however the case was dismissed for lack of jurisdiction. The claimant appealed. Held, the appeal would be dismissed pursuant to s 11(2)(c) of the Private International Law (Miscellaneous Provisions) Act 1995 which requires that the action for tort should be brought in the jurisdiction that the most significant element of the events occurred.
