Several ship owners created an association of ship owners, exclusively for their members to carry cargo at profitable rates and provide incentives to shippers to only use their ships. Part of the association’s regulations penalised any shipper or agent who used ships out with the association. The plaintiff, a ship owner not party to the association sued the association members for damages for conspiracy to injure their business. Held, the acts of the defendants were not unlawful and the plaintiff had no cause of action.
