A small boat was abandoned on a derelict part of a council estate. The council did not cordon off the boat but simply place a ‘danger’ sticker on it. A 14 year old boy, the appellant, attempted to restore the boat but was paralysed when it collapsed on top of him. He sued for damages. The judge awarded damages but reduced them by 25% due to contributory negligence.
