In 1762, king’s officers, the defendants, entered into the plaintiff’s home with a warrant issued by the secretary of state for the Northern Department and forcibly seized papers. The plaintiff sought damages against the king’s officers for entering his house illegally. The defendants claimed that they had not entered illegally as they had a warrant issued by the secretary of state. It was held that the entering of the plaintiff’s home and seizing of documents was illegal because the secretary of state lacked the legal power to issue such a warrant.
