Bolton v Stone [1951] AC 850, [1951] 1 All ER 1078
A man, whilst standing on a residential street pavement, was injured by a cricket ball hit from a cricket field located alongside the residential houses. The field was enclosed by a 7 foot fence, which stood 17 feet high due to a slope between the field and street level.
The man claimed damages from the cricket club members on the grounds of negligence or nuisance. It was held that although it may have been foreseeable that the ball could be hit over the fence, this was not sufficient to establish negligence, because the risk of injury was so remote that a reasonable person would not have anticipated it.
