An express trust arises because of a directly declared intention - an implied trust on the other hand arises by operation of law, against a background of actual or presumed intention. The implied trust will either be 'resulting' or 'constructive'. The documentary requirements of the Law of Property Act 1925 do not apply to the creation or operation of resulting, implied or constructive trusts (s.53(1) LPA 1925).
