European Law : Case List
This is a unique legal system that runs along with the law of the individual EU Member State that is found to have direct effect on the basis of the decision in C-43/75 Defrenne v. Sabena [1976] ECR 455 within the British legal system under remit of the European Communities Act 1972 and thus has also been found to override national law in many areas in view of the principle of supremacy expressed under Case 6/64, Falminio Costa v. ENEL [1964] ECR 585.
Therefore, with this in mind, the EU is not a federal government, nor is it an intergovernmental organization and constitutes a new legal order for the mutual social and economic benefit of all Member States across the EU under a system of supranational law that was founded upon the Treaty of Rome 1957 that then became the EC Treaty as it was amended.
