Equity Law : Case List

This area of law involves legal principles that serve to supplement strict rules of law where their application in the common law system would operate harshly to achieve ‘natural justice’ by operating on the conscience of the defendant aimed at a particular person, and their knowledge, state of mind and motives may effect as to whether a remedy will be granted.

This because, as was recognised by Lord Cowper, in Dudley v. Dudley (1705) Pree Ch 241, equity is actually “no part of the law, but a moral virtue, which qualifies , moderates and reforms the rigour, hardness and edge of the law, and is a universal truth” that also “assists the law where it is defective and weak in the constitution (which is the life of the law) and defends the law from crafty evasions” without actually changing or adding to it in anyway.
