Someone is guilty of an attempt under section 1(1) of the Criminal Attempts Act 1981 if they act in away that is more than merely preparatory with intent under the remit of section 1(4) of the Act to commit an offence so it is made up out of the actus reus and mens rea in looking to determine whether the accused commits the full offence and has passed the preparatory stage then it is no defence they then withdrew from completing the offence.
