Incorporating the Charging Standard – Examples of Offences

(i) The offence of common assault is committed when someone either assaults another person or commits a battery contrary to section 39 of the Criminal Justice Act 1988 in keeping with DPP v. Little (1992) 1 All ER 299.

(ii) Assault occasioning actual bodily harm is committed when someone assaults another person and causes actual bodily harm, under section 47 of the Offences Against the Person Act 1861.

(iii) In relation to unlawful wounding inflicting grievous bodily harm, under section 20 of the Offences Against the Person Act 1861, the offence is committed when someone unlawfully and maliciously wounds, or inflicts grievous bodily harm, upon another in keeping with DPP v. Parmenter [1992] 1 A.C 699.

(iv) The offence of wounding causing grievous bodily harm, under section 18 of the Offences Against the Person Act 1861, is committed when someone unlawfully and maliciously, with intent to do some grievous bodily harm, or resist or prevent the lawful apprehension or detainer of someone, either wounds, or inflicts grievous bodily harm, upon another in keeping with R v. Burstow [1998] AC 147.
