Denial of access to family members

W v United Kingdom (1987) 10 EHRR 29

The Court held that mutual enjoyment by parent and child of each other’s company constitutes a fundamental element of family life and that this relationship is not terminated when a child is taken in to care.

The local authority placed S with foster parents with a view to adoption, and decided that access to the child should be restricted, without further reference to the applicant or his wife.

The applicant’s youngest child, S was voluntarily placed in the care of the local authority.
