This area of law concerns the rules and regulations that a foreign person must look to fulfil if they wish to take up residence in this country. Generally, in relation to where issues of law have arisen, it has been taken to usually involve people from poorer countries in Eastern European, the Middle East, Asia and parts of Africa that come to this country as refugees in search of asylum and, where they are given leave to enter the country by the Secretary of State, they will then seek to claim such rights for themselves under the remit of the Asylum and Immigration Act 1996 domestically.
Moreover, such rights must also be recognised in keeping with international provisions including the Refugee or Person in need of International Protection (Qualification) Regulations 2006, the EC Refugee Qualification Directive 2004/83, the Treaty of Amsterdam 1997 and the 1951 Convention Relating to the Status of Refugees.
