Human Rights Law : Case
This area of law involves the effective recognition of the fundamental rights and freedoms all people have in the UK under the remit of the ECHR 1950 that was not a part of British law, according to R v. Secretary of State for Home department, ex parte Brind [1991] 2 WLR 588 (although see also R v. Secretary of State for Home department, ex parte Bhajan Singh [1975] 2 All Er 1081), until it was successfully enacted and codified in by the Human Rights Act 1998 in 2000 in spite of already having an effect here.
The key rights and freedoms recognised include – (a) the right to life; (b) freedom from torture and slavery; (c) the right to liberty; (d) the right to a fair trial; and (e) freedom of thought and religion and these and others within the legislation must all be considered in any case before the courts domestically.
