Employment Law : Case List
This area of law relates to the relationship between employees and their employers and concerns the nature and scope of the relationship itself and where the relationship actually arises (i.e. what factors determine whether someone is self-employed or employed). Moreover, it also concerns the effective recognition of employees’ rights, under the Employment Rights Act 1996, along with matters of health and safety, discrimination, and the recognition of collective workforce agreements, as well as the continuity of service, along with pay and working conditions.
Furthermore, matters of suspension, variation and breach of contract must be considered, along with termination at common law and the types of termination, as well as issues of unfair, wrongful and constructive dismissal. Finally, this area also involves the consideration of issues in relation to redundancy, trade unions and maternity and parental rights and their expression in the circumstances of a given case to give effect to the rights of employees and their employers within the limits of the law.
