The plaintiff, in order to obtain possession of the house (under the Rent Restriction Acts) offered the defendant alternative accommodation and agreed orally that the new tenancy would be for as long as she or her son lived.
Four weeks after she moved the landlord then served a notice to quit and sought possession of the alternative accommodation.
It was held that giving up possession of the protected tenancy of the house and taking possession of the flat were sufficient acts of part performance and the oral contract was enforceable.
