Byrne v Van Tienhoven (1880) 5 CPD 344
On the 1st of October the defendant posted a letter offering some goods for sale. He then revoked the offer 7 days later; but this did not arrive with the plaintiff until the 20th October.
However, plaintiff accepted on the 11th of October by telegram and on the 15th October had also posted a letter confirming the acceptance.
It was held that the defendant's revocation was not effective until it was received on 20 Oct. This was too late. The contract was made on the 11th of October when the plaintiff sent a telegram.
