Consumer Law : Case List
Under the remit of the Sale of Goods Act 1979 and the Consumer Protection Act 1987, this area of law concerns the sale and distribution of goods and issues of quality and safety. Therefore, with this in mind, this area of law is universally applicable to all consumer contracts, for anything from a sandwich from a market trader to an aeroplane for a multinational company.
But it must also be recognised that the reality is that this may still be considered to be something of a misnomer, illustrated by the decision in Saphena Computing v. Allied Collection Agencies [1995] FSR 616, since there is no implied term unless otherwise stated in the Sale of Goods Act 1979, further supported by Wallis v. Russell [1902] 2 IR 585, Ir CA regarding the right of rejection.
