Case – Go West Ltd v. Spigarolo [2003] EWCA Civ 17
This case looked to effectively address the matter of what was considered to be a ‘reasonable time’ for either refusing or granting consent because the tenant in this case applied to the landlord for consent in order to be able to assign two leases, but the landlord refused.
The parties then continued to correspond without much success, before the tenant finally issued legal proceedings against the landlord arguing that they had taken longer than what was considered to be a ‘reasonable time’ that the court here determined would clearly vary from case to case.
