Clayton v. Clayton (2006) EWCA Civ 878
This appeal involved custody proceedings between the parents of the child in this case in 2002, whom the father then abducted and fled to Portugal with leading to considerable publicity in both local and national media before the father returned to be arrested and subsequently pleaded guilty to child abduction.
Therefore, the decision is particularly significant regarding the rebuttal of any notion section 97 of the CA 1989 prohibiting publications leading to children involved in proceedings being identified under the CA 1989 remaining effective even after they have been concluded, so it was for the court to then consider whether such an injunction remained in force.
