Case – Campbell v. IRC [1970] AC 77
Quigley was a university lecturer who had made a formal complaint about the behaviour of a colleague, but did not explore constructive dismissal, and then, a year later, appealed against an unsuccessful application for promotion. However, no disciplinary action was recommended and Quigley objected and resigned by letter and presented a claim for unfair constructive dismissal arguing the University had breached the implied term of trust and confidence with him.
But the Employment Appeal Tribunal dismissed the appeal because Quigley’s delay could not be justified by the time it had taken him to consult a solicitor and must have had some awareness a year earlier.
