Administrative Law Essay Case
This area serves to govern the workings of administrative agencies of government in relation to rulemaking, adjudication, or even the effective enforcement of an agenda. Since administrative law is a branch of public law it also looks to deal with the decision-making powers of the administrative side of government (e.g. tribunals) in areas including policing, international trade, manufacturing, the environment, taxation, broadcasting, immigration and transport.
As a result, the British legal system has served to develop the process of judicial review in relation to the reviewability of administrative bodies decisions coupled with legislation or other doctrines that have established standards for proper rulemaking that also apply to the decisions of semi-public bodies, including non-profit corporations, disciplinary boards, and other decision-making bodies. But judicial review is usually limited to issues of fairness and whether the act was ultra vires (see Ashbury Rail Carriage Co v. Riche (1875) LR 7 HL 653) beyond the powers of the body in question that may be set aside if it is considered 'Wednesbury Unreasonable'.
